Terms of Service
The short version. OTB Funded sells access to a skill-based evaluation on a simulated bankroll. We are not a sportsbook, we do not accept wagers, and you never bet real money with us or with our money. If you pass both steps on the rules locked in when you bought, you get a funded simulated account and an 80% split of the simulated profits, paid in real money after identity verification. The full terms below control.
1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and [COMPANY LLC NAME], doing business as OTB Funded ("OTB Funded," "we," "us," or "our"), with its principal address at [ADDRESS]. They govern your use of otbfunded.com, our challenge and funded accounts, our dashboards, our community spaces, and any related services (together, the "Services").
By creating an account, buying a challenge, or using the Services, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Responsible Play policy, which are part of these Terms. If you do not agree, do not use the Services.
Please read Section 19 (Disputes) carefully. It requires you to try informal resolution first and [may require individual arbitration and waive class actions, subject to final attorney drafting].
2. Eligibility
- You must be at least 18 years old, or 21 years old where the law where you live requires it, and able to form a binding contract.
- The Services are void where prohibited. You may use them only if doing so is lawful where you live and where you are located when you use them. It is your responsibility to know and follow your local laws. We may limit or block access from any location at our discretion, and we may use your IP address and other signals to do so.
- You may not use a VPN, proxy, or other tool to hide your location or to get around an eligibility restriction.
- You may not use the Services if you are on a self-exclusion list with us, if we previously closed your account for a violation, or if you are [an employee, contractor, or immediate family member of OTB Funded or its service providers, as defined by counsel].
- You must use your own true, accurate identity. One person may hold [ONE / A STATED NUMBER OF] account(s).
3. What OTB Funded is (and is not)
- Simulated accounts. All challenge and funded accounts are simulated. The bankroll, balances, picks, and profits shown in your account are virtual and are tracked against real-world odds and results for evaluation purposes only. No real wager is placed on your behalf with any sportsbook, and you are not wagering OTB Funded's money.
- Not a sportsbook. OTB Funded is not a sportsbook, bookmaker, casino, or gambling operator. We do not accept wagers, hold customer deposits, or pay winnings on bets.
- What the fee buys. Your challenge fee pays for access to our evaluation service: the simulated account, rules engine, tracking, and review. It is not a deposit, a stake, or a balance you can withdraw.
- Profit-split payouts. If you pass a challenge and receive a funded account, we pay you a share of the profits your funded simulated account earns, as a performance-based reward under these Terms. A payout is not the return of a wager.
- No other relationship. Using the Services does not make you our employee, agent, partner, or investor, and nothing in the Services is investment, financial, tax, or betting advice.
4. Challenge accounts and pricing
We currently offer the following challenges. Each is a one-time fee, charged in U.S. dollar value and paid in cryptocurrency (see Section 8).
| Challenge | Simulated bankroll | One-time fee (USD) |
|---|---|---|
| $2.5K Challenge | $2,500 | $29 |
| $5K Challenge | $5,000 | $59 |
| $10K Challenge | $10,000 | $99 |
| $25K Challenge | $25,000 | $199 |
Prices may change for future purchases. A change never affects a challenge you have already bought. Promotions, discount codes, and early-access pricing are subject to the terms stated with the offer.
After your payment is confirmed, we email your login details to the address you entered at checkout. A challenge is not issued until payment is fully confirmed.
5. Challenge rules
Every challenge uses the same rules, regardless of size:
| Steps | Two steps. Step 1: reach a +12% profit target. Step 2: reach a +8% profit target. [CONFIRM: Step 2 balance resets to the starting balance.] |
|---|---|
| Time limit | None. [CONFIRM ANY INACTIVITY RULE, e.g. account closed after [INACTIVITY PERIOD] with no picks.] |
| Max loss | 10%, fixed, measured from the account's starting balance. If your balance falls to or below the max-loss level, the challenge ends immediately. |
| Daily loss limit | None. |
| Pick size | Each pick must be between 1% and 3% of the account's starting balance, except that a pick at odds above +200 may be no more than 2% of the starting balance. |
| Minimum picks | At least 20 picks in each step. Hitting the profit target before 20 settled picks does not pass the step. |
| Odds range | American odds from −250 to +400, inclusive, at the time the pick is accepted. |
| Timing | Pre-match only. A pick must be accepted before the scheduled start of the event. Live/in-play picks are not allowed. |
| Markets | [ALLOWED SPORTS, LEAGUES AND MARKETS, e.g. moneyline, spread, total]. [PARLAY POLICY]. |
Settlement. Picks are graded using official results as reported by our odds and results data sources. Pushes, cancelled, postponed, or voided events return the pick amount to your simulated balance [and do / do not count toward the minimum pick count].
Rules locked at purchase. The rules shown on our site at the moment you buy a challenge are the rules for that challenge, start to finish, including its funded stage. If we change our rules later, your existing challenge keeps the rules you bought. This does not limit our rights under Sections 11 to 13 (prohibited conduct, odds errors, and termination), which apply to every account.
6. Funded accounts and profit split
- When you pass Step 1 and Step 2 and complete identity verification (Section 10), you receive a funded simulated account of the same size as your challenge.
- You keep 80% of the net simulated profit earned in your funded account, as calculated by us under these Terms. We keep the other 20%.
- Funded accounts follow the same pick rules as the challenge (Section 5) [plus: FUNDED-STAGE RULES, e.g. max loss, minimum picks per payout period].
- No payout caps and no cash-out fees apply. Blockchain network fees for sending a payout are [PAID BY OTB FUNDED / DEDUCTED FROM THE PAYOUT].
- [PAYOUT ELIGIBILITY: minimum payout amount, how often you can request a payout, and whether the balance resets after a payout.]
7. Payouts
- Verification first. No payout is approved until you pass identity verification and we complete a review of your account activity for compliance with these Terms.
- 48-hour payouts. Approved payouts are sent within 48 hours of approval. If we miss that window for reasons within our control, we add a late bonus of [LATE BONUS AMOUNT OR FORMULA] to that payout. The 48-hour window does not include delays caused by you (for example, an incorrect wallet address), by blockchain network congestion, or by events outside our reasonable control.
- Fee refund on pass. When you pass a challenge, your challenge fee is refunded with your first approved payout from that funded account. See our Refund Policy.
- How you are paid. Payouts are sent in [PAYOUT ASSET AND NETWORK] to a wallet address that you control and that is in your name where we can verify it. You are responsible for giving us a correct address on the correct network. Crypto transfers cannot be reversed; we are not responsible for funds sent to an address or network you provided in error.
- Public payout ledger. We publish payouts on a public ledger. The ledger shows [LEDGER FIELDS, e.g. date, amount, account size, and a pseudonymous handle or transaction reference] and is described in our Privacy Policy.
- Taxes. You are responsible for any taxes on payouts you receive. We may request tax information [TAX FORM PLACEHOLDER] and may withhold or report payouts where the law requires.
- Withholding. We may delay, reduce, or deny a payout, and recover amounts already paid, if we reasonably determine that it resulted from prohibited conduct, an odds or data error, or a breach of these Terms.
8. Payments (crypto)
- At launch, challenge fees are paid in cryptocurrency (for example USDT, USDC, BTC, or ETH, as offered at checkout) through [PAYMENT PROCESSOR], a third-party crypto payment processor. You complete payment on the processor's hosted payment page and may also be subject to its terms and privacy policy.
- Prices are set in U.S. dollars. The amount of crypto due is quoted by the processor at checkout, which may include network fees and [PROCESSOR FEES, if passed to the customer]. Quotes may expire after a short period.
- You must send the exact amount, in the asset and on the network shown. Payments sent on the wrong network, in the wrong asset, or to an expired invoice may be delayed or unrecoverable.
- If you send less than the amount due (for example because an exchange deducted a withdrawal fee), the payment is treated as partially paid, and your challenge is not issued until the issue is resolved under our Refund Policy.
- We are not responsible for crypto price changes, network delays, or the acts or outages of exchanges, wallets, or the processor.
- We may add, change, or remove payment methods and processors at any time.
9. Refunds
Challenge fees are non-refundable once any pick has been placed on the account. Refunds before any pick, refunds of the fee on a pass, and crypto payment problems are covered in our Refund Policy, which is part of these Terms.
10. Identity verification (KYC)
- Before any payout, and at any other time we reasonably request, you must verify your identity, age, and location. This may include a government-issued photo ID, a selfie or liveness check, proof of address, and confirmation that you control your payout wallet.
- Verification may be performed by a third-party identity verification provider, [KYC VENDOR], as described in our Privacy Policy.
- The name on your verified ID must match the name on your OTB Funded account and payout details.
- If you cannot or do not complete verification within [KYC DEADLINE], or if verification shows you are ineligible, we may withhold payouts and close your account. Accounts closed because the holder was ineligible are handled under Sections 2 and 13.
11. Prohibited conduct
You agree not to, and not to help anyone else to:
- Multi-account: open or control more than the permitted number of accounts, use another person's account, or let anyone else use yours or trade on your behalf.
- Collude: coordinate picks with other participants, hedge or copy positions across accounts (including opposite-side picks across accounts), or share accounts, signals, or strategies designed to guarantee a pass across multiple accounts.
- Exploit stale odds or errors: take advantage of delayed, stale, mispriced, or obviously wrong odds; of events that have already started or ended; or of any bug, glitch, data-feed delay, or system error.
- Use bots or automation: use bots, scripts, scrapers, or automated tools to place picks or access the Services, except as we expressly allow.
- Abuse the Services: use stolen or unauthorized payment methods or identities; provide false information; evade a block, ban, or self-exclusion; attack, overload, or reverse engineer the Services; or harass our staff or community.
- Use strategies we reasonably determine are designed to exploit the simulated nature of the account rather than show genuine skill [EXAMPLES TO BE DEFINED BY COUNSEL, e.g. all-or-nothing gambling patterns].
- Use the Services in violation of any law or these Terms.
If we reasonably believe you engaged in prohibited conduct, we may void affected picks, reset or close accounts, deny or reverse payouts, and keep fees paid, in addition to any other remedy. We will tell you the reason where we can do so lawfully and safely.
12. Odds errors, data issues, and settlement
Odds and results come from third-party data sources and can be wrong or delayed. If a pick was accepted at odds that were clearly wrong, after the event started, or because of a data or system error, we may void the pick, re-grade it at the correct odds, or correct the result. We may also correct any balance, status, or payout calculation that was affected by an error. Our records of picks, odds, and results are final absent manifest error.
13. Our right to refuse service, suspend, or terminate
- We may refuse to sell a challenge to anyone, and may cancel an order before a challenge is issued, for any lawful reason (in which case we refund that order under our Refund Policy).
- We may suspend or terminate your access, or any account, at any time if we reasonably believe you breached these Terms, if required by law or a payment or verification partner, or to protect the Services or other users.
- If we terminate for your breach, you forfeit your fees and any unpaid profit split. If we terminate for reasons that are not your fault, [REMEDY TO BE DEFINED BY COUNSEL, e.g. a refund of the fee for an unused challenge and payment of any approved, earned profit split].
- You may close your account at any time by contacting us. Closing does not entitle you to a refund except as stated in our Refund Policy.
14. Your account and security
Keep your login details confidential and tell us right away at [CONTACT EMAIL] if you think your account has been accessed without permission. You are responsible for activity on your account. We will never ask for your wallet's private keys or seed phrase.
15. Intellectual property
The Services, including the OTB Funded name, logos, mascot, site design, and software, are owned by [COMPANY LLC NAME] or its licensors. We grant you a limited, personal, non-transferable right to use the Services under these Terms. You may not copy, resell, or create derivative works from them without our written permission.
16. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, or that you will pass a challenge or earn any payout. Past results, including any statistics we publish, do not predict future results.
17. Limitation of liability
To the fullest extent the law allows, OTB Funded and its owners, staff, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the fees you paid us in the [12] months before the claim or [$100]. Some places do not allow these limits, so they may not fully apply to you. [LIMITATION TO BE FINALIZED BY COUNSEL.]
18. Indemnity
You agree to indemnify and hold harmless OTB Funded and its owners, staff, and providers from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
19. Disputes
Governing law
These Terms are governed by the laws of [GOVERNING STATE], without regard to its conflict-of-law rules.
Informal resolution first
Before starting any formal proceeding, you agree to email us at [CONTACT EMAIL] with your name, account email, order ID (if any), and a description of the dispute and the remedy you want. We will try in good faith to resolve it within [30] days. We will do the same before bringing a claim against you.
Arbitration
[ARBITRATION CLAUSE PLACEHOLDER: to be drafted by counsel, including arbitration provider and rules, seat/venue, fees, small-claims carve-out, opt-out window, and mass-arbitration procedures.]
Class action waiver
[CLASS ACTION / JURY TRIAL WAIVER PLACEHOLDER: to be drafted by counsel.]
Venue
Any dispute not subject to arbitration will be brought only in the courts located in [VENUE COUNTY AND GOVERNING STATE], and you and we consent to their jurisdiction.
20. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you by email or in your dashboard. Changes apply going forward. Changes to challenge rules never apply to a challenge you have already bought; that challenge keeps the rules locked in at purchase. Continued use of the Services after a change takes effect means you accept the updated Terms.
21. General
These Terms are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, sale, or reorganization. Neither party is liable for delays caused by events beyond its reasonable control.
